Thanks tremendously once again peeps for your advice and suggestions!!!
I believe I'll speak with my agent in the AM first and try to iron out all the details with her and get on track with this deal...
I'll tell you guys what, I do plan on getting another s2k soon but if I don't or it takes awhile or whatever, I'll always be a paying member to this site just for the great, great people associated with it...
A million thank you's folks!!!!!!!

I'd avoid getting an attorney at least until you see what the Insurance Co. is going to offer you.
Your agent should be helping you through the process, and wait to see what the claims adjuster offers. It should be fair, and you have some negotiating power there. The POA, as mentioned, is most likely to deal with your finance company. It is most likely not in your best interests to get an attorney over a one-car accident without bodily injury. An hourly fee will get expensive REALLY quickly, or their 1/3 recovery will eat up a large amount of your settlement. Good luck in dealing with everything, its a pain, but hopefully they'll take good care of you.

dont hire a lawyer.
erie insurance is better than most companies at paying quickly and fairly. they wont try to screw you, as say nationwide or allstate would. Erie relies on word of mouth for alot of it's business so they try to keep their customers happy.
If you sign the power of attorney, ask them to amend it to only deal with the paperwork associated with the payoff of the car to the creditor and the dmv. Power of attorney forms aren't always universal, you can narrow them down to deal with specific things too.

Sweet... Thanks guys for all the advice!!
Things went well today talking with my agent and talking with the adjuster too... I understand things better now and feel pretty confident on this matter being resolved fairly and promptly...
It appears the car will indeed be paid off at least and I'll be able to get a few of my aftermarket parts back...
It does not seem as if I'll need a lawyer for this at all thankfully b/c I really did not wanna go that route...

I always thought that Duke should have hired Jimmy V. when we hired Coach K. Now, K's results speak for themselves, and I'm glad I'm going to be able to use my season tickets to Cameron again.
But I met Jimmy V. in person several times, and there was never a more genuinely friendly, outgoing, and personable guy born on this earth. 2 minutes talking to him, and it was like you were lifelong friends! An airplane ride seated next to him to Atlanta, and you were family! I know he had some issues - who among us doesn't - but Coach V. was a true gentleman. I'm a Duke grad who is very proud to quote an NC State coach in his sig, and very proud to have know the man, even briefly.

Wow, that's awesome!!
I just know him from the TV replays as I was just a small young'un when he was coaching, but I'm a lifelong NC State fan...
Hopefully the issue we're having now will pass...

Well, get yourself back on the road, man, and let's meet and drive! NC State and Duke share a lot of common history, and I lived through most of it.
And by all means, if you make it to the Dragon, please introduce yourself if I don't find you first. I'll be the guy toting 2 kids and a Miata-driving +1
