Default My Baby got towed!

I had a meeting that ran late and I could not get to her in time, so they towed her to this awful place on Wilkinson Blvd.

Believe it or not she did not have a single scratch on her! I was certain she would be scratched after reading the many tow truck horror stories.

She will be getting a few coats of Zaino this weekend to make up for it.

None of those tow lights magnetically plunked on the trunk lid with cords flapping around on the bodywork?

Nope. I did a very thorough check before I bailed her out. I was very surprised considering I was expecting the worst.

just curious, if there were some scratches or dent can we make them pay for it???
never been towed before so i don't know. it good to know for the future though

um..so if we go through our insurance to sue the towing company would that increase our premuim??
also if we do find damages ..leave the car there or take it home and call the insurance company (i assum we leave it there so they can't say we did it, but how can we prove it was cause by towing company..they can say it was there already??

If you go through insurance to repair damages, then yes, in all likelihood, your premiums would increase. As far as proving who did the damage, and whether or not it was there before, that would be something to be discussed in Civil court. Unlike criminal court, where you have to prove guilt beyond a reasonable doubt, a civil court only needs proof on a balance of probabilities. Therefore, if, say for instance, you have pictures of your trunk lid with scratch marks on it from the lights, say, in all *likelihood*, they were caused by the tow company's lights. If you are planning on pursuing this route, it is best to keep the car where it is (in custody of the tow company) thereby making them liable for all damage until you retrieve your car.

Again, the burden of proof is much lower in Civil courts, thus making your claim easier.

Again, I speak only of my knowledge of the Canadian court system here in Alberta. Your mileage may vary.

Poor baby! Hauled off to jail while she was completely innocent. Hope she's feeling much better now.
