Default Failure to display tax disk - Penalty notice

Morning all.

The tax on the MX5 expired end March and the new tax disc arrived in the post a few days after that.

When it arrived I stuck it in the tax disc holder in a bit of a rush on the way to work the following morning.

Ali went outside today to find a fixed penalty notice for £100 on the car for failure to display a valid tax disc. Eh??

When I looked I'd slid the new tax disc in behind the old one by mistake so while the car IS taxed, the new one wasn't on display.

Are we fooked for the £100 because of my stupidity?

To the letter, yes, however, if you explain your position in the way you have here and the authorities can verify the fact you purchased new tax before the old expired (although your comment here looks (wilfully?) vague in this respect, you may get away with the fine.

If the truth is that your tax expired then you bought new, I think you will not be successful in any appeal.

Old one expired 31/3

New one bought online 2/4

(Didn't notice it had expired but only 2 days)

I think you've answered your own question. If you had purchased pre expiry, then you would have a whiter than white argument. Your current situation has its wheels wobbling before you have begun.

If the day you were spotted is a long time after you received then you can but try but when they start digging, it's obvious that you broke the law for at least 1 day.


I think this may have to go into the experience bank.

Bend over and open your wallet.

I'd pay the fine rather than highlight the car wasn't taxed for two days, thereby voiding your insurance....

Quite ironic given that they are doing away with Tax discs soon!

These things are always worth the effort to complain in my experience. Might get let off, might not but worth a punt for £100.

I'm guessing like a speeding ticket they have to provide photographic evidence?

May as well follow the process see if there is any chance of getting out of it.

There's no why that you will get off with this, failure to display your tax disk is not the same as not paying for it, I've heard this so many times as a magistrate, one case where a young lady had her tax disc sitting on her desk at work for a month, she came in with proof of when it was bought, unfortunately her desk was not her car and so had openly admitted her guilt so the fine had to stand, in the OP's case he cant say the disc wasn't visible as that again is an admission.

Photographic evidence is not required, just a statement from the issuing officer.

Not having tax will not invalidate your insurance.
