thats the thing that bothers me , im the only one that says there is a problem so it goes over to being ' monitored ' and i get told ' they passed an MOT so are safe....

That's borderline criminal.
Tyres wear out - an MOT lasts for a year, so those tyres could have done a hundred thousand miles since the MOT!

Can you refuse to drive the car until they fix the problems?
Could you drive it to an MOT centre and get it tested again?

As I understand it, legally you are responsible for the roadworthiness of the car you drive. If you were driving somebody else's car with bald tyres and you were stopped the ticket/fines would be your responsibility.

In a past life I refused to use a pool car because I couldn't varify that it had an MOT - it turns out it was months overdue - because I would have been liable. When this was pointed out to my employers they soon found me another...
