Basically him and his passenger were pretty messed up from the incident as well, think they spent 3-4 weeks in the hospital because of it and the words from the police officers themselves were "They've been through enough as it is". If they weren't injured we were told they would have put it to the crown prosecution services but as it was they didn't even put it forward for the courts to look at.

Are you saying that an uninsured, banned and drunk driver caused the accident that killed your brother, in this country, and that the Police acknowledged that and said "They've been through enough as it is"?

There would have to be a bit more to it than that. Or it happened in Albania.

Without wishing bad memories for you on this horrible incident, Did you consider a private prosecution?

That is honestly what happened, in this country, in Suffolk. The driver got off pretty lightly, damage to his leg i think he was in a cast for 6 months but is fine now. The passenger got off a bit worse i think he ended up with some kind of brain damage because their tool weren't tied down.

I think my mum considered private prosecution but them 2 also came after her as the insurance are in the process of suing my mum and trying to pull out. This was all 2 1/2 years ago and is still going on.

The drivers insurance won't help him at all given the state he was in when he crashed so he's had to go through private prosecution against my mum as well but again don't think they have much of a leg to stand on given the state they was in when the crash happened.

Yea, my mum was the policy holder and my brother was a named driver so the insurance company are saying she fronted (which she most certainly did not and has forwarded more than enough proof). So the insurance company have moved on to another thing to try and pull out so we are in the process of fighting that. Funniest thing out of all of it is. The drivers lawyer has asked my mum to side with them against someone in a case related to all of this as well. Whole thing has just been a huge nightmare that we are still living through.
