*PARTICULARLY* coming out of a tunnel (glare) and in an urban environment where exits, slowdowns, and stoppage can be *expected*.

I pass on the right *only* when there's no other option AND I can see that the traffic is flowing well enough, far enough ahead of me, that I absolutely KNOW I can make the pass.

The guy was driving like an idiot, PERIOD.

Even if the lane is open, I hate passing on the right because people at a complete stop think that they can pull out in front of you. Nothing pisses me off more than that.

I'd follow the rules and pass on the left if idiots in the @#$@# left lane went faster then the DAMN right lane! hawaii drivers = don't move over for faster moving traffic, they dont understand left = faster than middle/right...etc. If the right lane is open, I'll take it.
