Honda isn't doing the same way as Toyota is because Toyota patented their hybrid system. if you recall, Ford almost got sued because their hybrid system was similar to Toyota's
GM's 2-mode is another full-hybrid. And you don't see Toyota sueing them based on your logic.
Honda just took the easy way out. They could have build a full-hybrid, but decided they are a better ICE maker. They could build a plugin series hybrid with their FCX.... but did not.
By the way, Toyota is being sued for their PSD hybrid transmission... of all things... a boat maker.

And I'm slowly coming to terms wit the fact that I might get forced into a CVT or a semi-auto with paddle shifters and only 2-pedals on the floor, which seems to be the way all hybrids are going.
