Thumbs up Speeding Ticket Question



I'll make this simple n' sweet:

I got a speeding ticket on the 5 fwy.
The ticket says "80+"
Should I fight it because the occifer did not put an actual speed?

A friend of mine says he put that to simply say I was going 15+ over the limit, hence I do not qualify for traffic school, but I SWEAR that you are only ineligible for traffic school if your'e going 25+ over the limit.

???

I'll make this short and sweet. You're eligible if the Judge allows it.

Go see the Judge, request traffic school. He will tell you or not if you can go.

the rule is definitely not 15+ because i got a ticket in December for 24mph over and i'm eligible for traffic school. If you get a courtesy notice, it should tell you if you're eligible for traffic school or not. But yes, in the end, i believe you can even ask the judge for it (if your courtesy letter says you are not eligible). Judge has the power!

The law says "over 25 mph over the speed limit". I got a ticket for 90 mph once, the judge said i wasn't eligible, and I politely told him that I thought the law said that it had to be OVER 25 mph over the limit. He looked it up and said that I am eligible.

As long as you haven't done traffic school within the past 18 months and you were not 25+ over the limit, you are eligible if you plead guilty to the offense. If not, the judge can still allow you to take traffic school to take the point off your DMV record, but it won't be hidden from your insurance.

worth it to fight it.
delay it twice, go in and request a 'trial by written declaration', you fill out a form saying why you are not guilty.
the court then sends a notice to the officer that ticketed you to put in a report. if he doesn't reply your ticket gets dropped. but if he does and the judge decides you are still guilty you get another chance by requesting a 'trial de novo'. it's treated as a brand new case but you must show up to court. try to delay it one more time and go in court. cop doesn't show up, your ticket gets dropped, don't tell the judge you'll accept a postpone until the officer is ready since you are busy. if the cop shows up to court and still remembers you to testify against you, you can still ask for a traffic school from the judge.
