Speeding Ticket but no radar gun

Default Speeding Ticket but no radar gun

My Girlfriend just got a speeding ticket from a Highway Patrol, He said she was going 80mph on 65mph. When we ask to see the radar gun the officer said he didn't catch her on the gun but was actually pacing her. Can my girlfriend fight the ticket??

sure, she can fight any ticket, but it's her word against the officer's word, and that doesn't really bode well (unless the officer doesn't show up for court).

If it were radar you would have a shot. Pacing is basically game over.

can't hurt to do a trial by declaration. the most you'll waste is a stamp and some paper

I won against pacing.

The officer got on a ramp behind me, I saw him merge and start his "pace", which lasted about 10 seconds at best as he gained on me. The judge asked him if he indeed came from that ramp and he said yes.

The judge said there's a minimum pace period and that isn't long enough to judge speed.

Lucky win for me.

Dismissed.

^ Only the judge can decide that. They often SAY no but the judge can decide as he/she sees fit. I saw numerous people ask for traffic school after they showed up and the judge said yes or no and gave a reason. Least that's how it went from what I saw.
