Well don't we contribute to this somewhat? I mean if you're running a TP but get it smogged with the cat on then that's kind of fraud right? Because for the most part of the year you run a test pipe which won't pass smog yet for the smog test which is, what, once every 2-3 years, you run a cat to pass smog.
