Default rear ended... insurance issue

My friend was rear ended while at a red light and he bumped into the person in front of him. A lady who hit him knew it was her fault and assumed all liability. My friend then took the car to get an estimate and the total damage was $1500. He gave the estimate to the lady's insurance adjuster and then her insurance adjuster approved it. They then told my friend he could take it to the shop to get it fixed so my friend did so under the assumption that the her insurance would pay for it. Later, the lady's adjuster called my friend saying they will not pay for everything. They said that because my friend had scratches on the bumper before the accident, he must pay $300. My friend called his insurance company but they said he has to talk to the lady's adjuster himself. So the lady is only going to pay him $1200. Is there anything he can do?

have him talk to his insurance broker or whoever he has for their advice?

i had the same exact thing happen to me

doesn't matter if there was a scratch before the accident.. bumper is whole piece, u can't just fix bumper w/ previous scratch... even if there was no scratch, the damanage would of made painting the bumper. also, he should tell lady's insurance adjuster, what proof do they have there was a scratch before the accident. if it's possible, your friend should contact the lady ask her to talk to her insurance company to pay up or your friend is going to hire a lawyer which will cost $$$ on lady's insurance.

he talked to his insurance and they told him that he had to talk to the lady's insurance company himself. so he doesn't know what to do.

get a lawyer . if isn't your falut which it weren't . the lawyer will take care of that. and if you don't earn any money. the lawyer won't charger you!

He actually uses state farm, but yeah i dont' know why. it sounded weird when he told me but i guess he should talk to them again.
