OMG! carnegie ins sucks
i was recently rear ended by carnegie insurance holder
he rear ended me on a freeway and ran away
after half hour police caught him running away
long story short
today i got a complete collision report and they determined it to be 100% his fault
so i made a claim and adjuster called me
and he told me he has very small coverage and my damage will not be covered fully
he convinced me to make a claim to my insurance to get a full amount money for
collision repair if i go through his insurance
he said i have to be responsible for 50% of damages on my car when it is not my
falut at all???
what the PHOCK is this???
plus adjust offer me to take 15 dollar rental car when my car is worth like 34000
new????
he said " we have to minimize the expands on rental car to cover you more on
collision"

Yep, one of their insured backed in to my car in a KFC parking lot. Luckily, the guy stuck around. However, they tried to say it was my fault because I have a small car and its lowered. Therefore, anyone can just miss seeing the car.

welcome to the club! i was just rear ended on sunday by a lady in a *^%$ing hurry to get to her grandson's camping trip, yada yada yada. She has State Farm insurance and I have yet to get an estimate on the repairs, but I will be really pissed if I have to pay one #&*^ing dime! Sorry I'm still really upset about it. your explanation confuses me.
how much is your deductible?
what are his coverage limits for property damage liability? CA state minimum is $5,000 for property damage. is your damage estimate over that? if it is, your two choices are to make a claim under your Uninsured/Underinsured Motorist property damage coverage OR take that guy to a small claims court (which will probably not be worth the time and effort).
rental car coverage, if being covered by the other party's insurance does come out of their Property Damage liability coverage... so yeah, in theory, it is true that if you try and take out a more expensive rental car, you're reducing the amount of coverage available from their Property Damage limits.
if youre making a claim through your own insurance, in order for them to try and get reimbursement money from the other party, your damages have to come out to more than your deductible. that way your ins.co. will pay the extra difference to you and try to get their money back from the other party's ins.co AND as well as your deductible. if it comes out to less than your deductible, unfortunately YOU have to then pay it first and send that bill to the other party's ins.co and wait for them to pay you back.

on a side related note, one of my customers got side swiped by a car with 3 hispanic gangsters. it was their fault because they crossed over into his lane (from the opposite direction). they jumped him in the middle of the street and the cops came. the cops then proceeded to arrest everybody, including my customer. . those guys had no licenses, registrations, insurance.
