Mr. A ran a stop sign and side swiped my dad. My dad is okay, but my VW Jetta is pretty jacked up. It may be totaled. I only had liability coverage on it.
My dad was in the middle of the intersection when he got hit. The police report says the other driver ran the stop sign and hit my dad.
However, Farmers Insurance (the other guy's insurance) is only claiming 70% fault because they said that my dad wasn't 100% sure that the guy was going to stop, so he should have waited to enter the intersection. The thing is... my dad was already in the intersection before he even saw the guy come and run the stop sign.
Farmers told me that they're not budging, and if I want them to pay 100%, then I have to sue them.
So, what's the process of filing a lawsuit? What things do I have to keep in mind? How long would the process take?

Do you have any recommendations for collission attorneys or what to look for? Most of the ones I see in the phone book specialize in bodily injury.
The wholesale blue book value of my car is only around $7000, and the retail market value is around $10,000. Is it still worth spending the money for an attorney? Can I add his expenses to the lawsuit? Do you know of lawyers that will only charge $ if they win?
