Help with roomate legal advise
Sup everyone.
A friend of mine has a apartment that he shares with a roomate.
She is not on the lease,
She is a drunk
She brings random guys over
and he finds stuff missing of his.
He gave her a verbal 30 day eviction notice on the 7th of August
she has until September 6th to get out. But she texted him writtng that she never recived any notice in writting and that she will not leave untill the end of September.
Trust me if i were him i would say "wait untill the end of the month than it will be over", but its very bad between them, Shes a drunk and she is very dirty. he cant have her there any longer. Plus he has somone to moving in on the 7th of September.
The landlord has been informed of the situation regarding the 30 day eviction.
nothing in writing though!
The landlord can vouch for him though!
I saw and read forms on the internet about a 3 day pay or quit, but i dont think that applies.
the sooner shes gone the better.

I'd put her stuff outside the same day. That's just me though, and I think someone who's lived with me knows that I'm willing to physically harm them if they cross me. So maybe that's different.
In any case, without being on the lease.... I'd put her stuff to the curb and let her know to pick it up. Don't do it without confirmed contact of course.

i have evicted a room mate a few years ago and he WAS on the lease. i gave him a 30 day notice in which he signed and i had notorized. when it comes to situations like this it's always best to put EVERYTHING in writing and have it signed that way both parties are aware of the situation.
verbal is as good as nothing... your buddies circumstances are different as she is NOT on the lease and if it were me i'd have her out in 7 days or less.
i interview the hell out of any roommate that im considering adding into my home... even if they're my friend. i don't have many rules but i expect to have common areas such as the kitchen and bathroom to be clean... if you make a mess you clean up your mess. anything that goes on in your room is none of my business.
