conditional sale contract, means that certain conditions need to be met.

have to read to contract to determine what those conditions are, in order to demand a refund.

deposit is to secure a conditional sale...

downpayment is towards a financed loan (which would mean the sale is complete).

I was quoting the civil code......this is not from the sales contract..

i know, you were using the civil code as an argument for demanding a refund...and the civil code specifies conditional.

so still need to read the contract to see what it states exactly.

i'm not so much concerned about crossing out and editing, as not initialing, i presume invalidates the edit.

even if the dealer A is wrong...

the next step is to take them to small claims court.

so might as well do that anyway as the next step and they'll probably pay up.

in this case.. they are basicallly the same. the deposit goes towards the purchase. but if she didnt end up purchasing... she is entitled to get it back. when im at work tomarrow im gonna ask someone above me about this situation and see if they can actually cross out a phrase on a contract.

thats the only disputable action i can see..

here is the solution to this prob... i was pretty sure this was it but i double checked...


threaten to go to the dmv if u dont get the deposit back. dmv has a team of investigators.. dmv has the power to shut down the audi dealer if they had a reason to. they wont want the heat.

it is illegal for them to not refund the deposit even tho she signed a paper for a non refundable deposit.

Thanks, Justin. But she tried contacting the DMV attorney who wants to see the contract.

I think it is illegal too, but I need a "smoking gun". Do you think the code I quoted is enough???

Maybe I can show you the contract someday soon.......?
