Yes, the CO knew about this debt in advance because I told him via PM. He PM'd me asking about the custom latches and after answering his question I stated that Jay still owed me $1200 and that it would be nice if he would pay the first $1200 of the sale directly to me. He didn't respond to that PM.

I think he is talking about the original purchase receipt, which I have from Bulletproof Automotive. However, that receipt, or even a sales agreement between Jay and I, wouldn't help me repossess the hardtop from the current owner because he is not at fault. A purchase agreement between Jay and I could be used for a small claims suit, but that doesn't guarantee retribution.

While the rights and wrongs of that can be debated morally, legally he has no obligation to give you the 1200 since the hardtop is technically the original buyers at the time of sale (even though he hadnt paid you in full at the time) Legally, all he did was go there and buy a hardtop at a certain price and has no obligation of getting involved of prior debts and other things...

Like I said, if he has full intention of paying you back and his word is truthful, ask him to sign a legal document stating that he owes you 1200 dollars. This will at least give you some piece of mind and show he is serious about paying you back. If he doesnt want to sign it, that means he has no intentions of paying you back, its as simple as that. If he were to sign such a document, to me, it would show that he at least cares...

I can tell you this though--had I been in that situation I definitely would have paid the originally seller (who was currently owed money) off before paying the new seller. Yea but what probably would have happened is the hardtop wouldnt have been released if Jay were shorted 1200 on the sale and youd still be out 1200...

Agree. With that said, Jay needs to post in this thread admitting his wrong doing, apologize, and meet with me to sign a payment agreement.

Haha, what do you know. I have PM's from Jay as recent as yesterday trying to buy my BB AP2 bumper for $250. He wanted to meet up ASAP. That is very shady! Ill find another buyer.
