IMO the OP and BSerious should have both met Jay at the sale, and had a police officer there and Jay coulda either given back the hardtop and the OP refund his down payment, or Bserious just give the OP $1200 and then the remaining balance of the purchase price he owed Jay

And this would be in a completely sound and reasonable world, which we do not live in. People have thrown away their morals and resorted to devious ways. If there's a will, there's a way, and at this point I see neither from the debtor.

This is a really disheartening situation because this is supposed to be a forum where fellow enthusiasts can gather and develop a sense of trust and unity amongst each other. However, there is always an instance where one person ruins the fun for everyone else. I truly hope that this issue is resolved in an ethical manner.
This is exactly how I feel. Most of the people on this forum are older and more experienced than I. This is a place where I can meet new people and eventually look up to some, as well. This sets a bad example for young people who are trying to embrace the caring community of S2KI, such as I. I am also very trustworthy and probably would have made a deal with with an S2KIer as the OP did. So I can't point my finger.

In the end, I hope everything gets resolved in a mature manner, and that the OP does not completely lose trust in S2KI members! GL

are you a lawyer? Don't tell him about his legal rights...

to the OP.. look up this term.. "bona fide purchaser for value without notice"...

You will find it interesting.

PS- I am NOT giving legal advice...
No, even someone who did not go to law school could interpret the fact that since there is no PROOF, only heresay as to the ORIGINAL purchase of this item, BFP does not apply to a second transaction since the first transaction may have allegedly never taken place. I guess common sense is getting harder to comeby these days.

Let's get to the bottom line here:

1. Jay has a legal, moral and ethical obligation to repay me the amount due.
2. Bserious *had* a moral and ethical obligation to pay me the first $1200 of the sale between he and Jay.

In any event, there isn't a written sales agreement between Jay and I, and we simply have to go by a person's word. I have spoken my side of the story; all of SoCal is waiting for Jay to tell his side.
i dont agree at all..

1st. it was 1000 not 1200
2nd. Bserious and no obligation to you what so ever. Considering jay sold the hard top not you
3rd. you an idiot for giving someone the hardtop and not getting all the money know matter who it is.
4th. Your very childish for making a tread on s2ki to make people go against a good person and have people take your side.
5th. NO MATTER WHO YOU ARE i dont care what you or anyone else says. FAMILY PROBLEMS COME BEFORE ANYONE AND EVERYONE ELSE.
6th. I dont agree with you going into and telling everyone about his personal life.

I do agree that.

1. Jay has a legal, moral and ethical obligation to repay me the amount due.

And you forgot to mention that jay called you on tuesday saying he had the 1000 and you said " oh i thought it was 1200" hummm.....wierd how the price just goes up....check you pm's before you try and get more money out of someone. and you should have just taken the 1000..your bad.

This is all my opinion and what i have read heard and witnessed withen the last week.

What! I hope this is a joke, or I'm not understanding you. How is a CO, (non paid volunteer), supposed to be protecting the community from fraudulent activity?
