It's 100% up to the discretion of the officer. It's based a lot on the guys bias at that very moment in my opinion. There is a guy with a E39 M5 with a obnoxiously loud exhaust that sounds SICK! But his neighbor in a EG has gotten half a dozen exhaust tickets and it's no where near as loud. A cop told me that if your car sounds like shit in his opinion (Subjective of course) it increases your chances. He also mentioned to me a certain situation like early in the morning during a commute a boosted car with a 4 inch exhaust flies by it just pisses him off

There are too many variables to give you a straight answer based on a single exhaust. If a cop feels like pulling you over they'll do it, either take the risk or play it safe and avoid exhausts.

EDIT: I'd personally play it safe, too many Cops in my area and I despise having to constantly adjust my driving style in their presence. Not to mention how nervous and paranoid it makes me. Imagine driving a run of the mill Camry with not a worry in the world, that's what it's like not having an exhaust on a S2000 for me at least.

^ It's so nice to see COPS make calls based purely upon mood and their own biased opinions and then admit to it openly. I can't stand pigs. There are so few good cops in comparison to how many pigs are out there.

CHP is such a useless organization of morons, it's amazing to see what the state employs.
