I had something like this happen. I had to pay my deductible to get my car fixed, but I complained and made a statement to the insurance company and got my deductible back. Keep bugging them so you are not penalized for this idiot's mistake.

If it's inside the parking lot, cops won't come. I had a co worker who got rear ended in a parking structure at the mall and when she called the cops, they said it was private property or something and that they don't come out for accidents in parking lots.
But if the damage is over $750, whether or not it was on public property, whether or not you were actually in the car at the time, you need to file a DMV report and blame will be assigned to someone. I'd rather it be someone at the scene than two insurance companies dealing behind my back.
