The cop can also determine if the other driver was really driving like a complete a-hole (as in the original post) and assign fault right there.
If this is not the case, then you have both insurance companies going after each other and they will wheel and deal with each other to assign blame and from that, how much each pays out.
That gets reported to the DMV and will determine if you get a hike in your insurance fees on the next renewal.
