uh yeah. no one said anything about not filing the claim with the dmv. that came out of no where. when you file a claim with the dmv, it's not required that you have a police report. so whether or not cops come out and file a report, you still report to the dmv regardless if damages are $750+
What I was saying is that if an officer shows up and writes up a police report, you at least have an option of talking to him along with the other party. The cop can also determine if the other driver was really driving like a complete a-hole (as in the original post) and assign fault right there.
If this is not the case, then you have both insurance companies going after each other and they will wheel and deal with each other to assign blame and from that, how much each pays out.
That gets reported to the DMV and will determine if you get a hike in your insurance fees on the next renewal.
