Oh yeah, great for them.

But if the damage is over $750, whether or not it was on public property, whether or not you were actually in the car at the time, you need to file a DMV report and blame will be assigned to someone. I'd rather it be someone at the scene than two insurance companies dealing behind my back.
uh yeah. no one said anything about not filing the claim with the dmv. that came out of no where. when you file a claim with the dmv, it's not required that you have a police report. so whether or not cops come out and file a report, you still report to the dmv regardless if damages are $750+

and a cop wasn't there when the accident happened so what he knows is what each person involved tells him. what he sees your insurance company can see from pictures and what they know is what both parties involved tells them.

point is, cops aren't going to come and file a report for an accident that is 90% likely to be a fender bender in a parking lot. They'll tell you to swap info and take it up with your insurance company. If you want to cover your ass, take pics of the accident and don't move your car and report it to your ins company asap so that the details are still in your memory.

when are you suppose to file this? After you get an estimate from the body shop?

within 10 days of the accident.. by then the adjuster should have come out and given you an estimate of damages.

you can get the form on the dmv website.
