If AB2289 goes into effect as written the car still has to pass the visual part of the SMOG test and I read where if the ....area for ozone or a moderate or serious nonattainment area for carbon monoxide with a design value greater than 12.7 ppm, and shall not implement the program in... blah blah blah. So if you live in a smoggy area I think you will still have to do tail-pipe testing.

I think you read that a little wrong Rod. Like I said I'm no legal expert but on page 6 line 27 (where you get that info from) it says it will be implemented in areas that fall into one of the categories of CO or O3. California fails on the on the CO (classified moderate < 12.7ppm) but is good to go on the O3 (classified serious) according to EPA standards held within.
