I heard that if you were using R-S3's, this wouldn't be a problem .

This happened to my RS3's as well - only found out when I was selling the wheels/tires

Yep. I believe the minimal required tread depth in CA is 1/32th in. on street tires.

Yeah, I still had at least 3/32 left from the wear bars on my RS3 & I remember a cop mentioned, "Your rear tires seem to be getting low there" - denoting the action of them checking on this.
