Im no expert in law but i think fastrk (prob the other electronic charging system) function more like a private business and send charges to people who dont have accounts.
Therefore as long as they can identify and charge toll the car that passed through the toll they leave law enforcement out of it. Only when the charges start to pend and become delinquent they send off stuff to law enforcement and DMV (hold on your vehi reg, ect..) and maybe a no front plate ticket?
kinda like red light cameras maybe? i dont know.
