instead he did what every one else does, he drove off, so now hes a phantom vehicle, and there was never any contact...so its now a single vehicle accident, and there can only be one person at fault for a single vehicle accident-the driver. i know it sux, but thats kind of one of those unwritten laws, other wise every person who crashed their car for real would just say some one ran them off the road, so thats the thing, no contact no subro.
ur ins should cover all of the damage if u have comp and collision, however it will go on ur record as at fault, and u will have to pay your deduct...sorry dude, next, let the guy hit you, then no deduct, and a bodily injury settlement
