cop clocked the wrong car?!

Radar could make or break the case. If he says he got you on radar, then like the other guy said, you have no chance, because it will be his word against yours.

You should do trial by written declaration at a minimum though, because there is always the chance that the officer doesn't submit his version of the story, in which case the charge is automatically dropped.

so all i do for the written declaration is put my info needed, case #, and mail it in and wait? o_O; i'm new to this method.

Trial by declaration is definitely the way to go. Police get overtime when they go to court, but NOT when they write written declarations. That is the way to go.

On another note, I got a ticket for 20 over 45mph and didn't have registration or current insurance, both of which I had, just not on me. My ticket was $1300!!!

I went to court to get my court date (yes, ass backwards) and the clerk asked for my proof of insurance and registration, then told me that my ticket was lowered to $200, with the additional $100 off the judge approved that day to settle. I was allowed traffic school and the only question I had was if they took American Express.

Once again, this is not necessarily true. I was radared doing 19 over speed limit, and I got out of the ticket with a trial by declaration. 22350 is for going too fast for conditions allow. When you write the letter make sure you only address the actual law you broke. You don't need to mention anything about speed limits. Just prove that your speed was safe for the conditions that day.

Good luck. By the way you should consider extending the ticket. You can get a 30 day extension by phone and even more if you go in person. The longer you drag it out the less likely the cop will write back.

How do you know the officer actually sent anything in?

They will tell you if you call and ask. Last time they told me it was dismissed for "lack of prosecution".
