Can I sell a car without smog? If its non-op?

Sell it as a parts car and state that in the "bill of sale." Something to the extent that car has no engine but is included in the sale as "parts."
Make sure you go to DMV and let them stamp the "release of liability" and keep a copy for yourself.

Its far from being in good condition, its been known as the nightmare car since ive owned it, lol. I couldn't sell it to a fellow s2ki'er with a healthy conscience.
I was originally going to pull the head of the engine this week and junk the rest of the car and had no plans to sell. But someone drove by, saw it and gave me an offer on it.

I spoke to someone and he said that if you sold it as non-op. the new owner would have to go to dmv and switch the paperwork over as non-op. he would then deal with the rest himself.
so say if the car isn't running. they can't expect you to smog it and sell it. the new owner would have to deal with that.

Yes, you can no op the car and you are free and clear.... or so you'd like to think. The registration for the car is basically givven to the DMV and the buyer will be repaying it, which for some cars can be $$$$$$$ If you no op it and sell it and nothing is stated in writing about the car having problems you still might be found liable in a lawsuit.
You can (according to the DMV themselves 3Q 2007) sell the car WITHOUT a smog as long as it is stated IN writing that the smog is the buyer's responsibility.... i wouuld also have this contract notorized to CYA. Think about it, how can you smog a car that is broken?
