Can I sell a car without smog? If its non-op?

Default Can I sell a car without smog? If its non-op?

I've been going through the DMV website and its driving me nuts.

I have this old 91 Integra with a B16 that I was going to give to pick and pull. But someone saw the car today and made an offer for it. I know in California its the buyers responsibility to smog the car before its sold, but what if the car doesn't run?

cant u state that you sold it "as-is" and the buyer is reponsible for smog. if it doesnt run you sell it as non-op. i bought my second rx-7 like that.

From my understanding the "as-is" doesn't hold in California as the seller must provide smog. Supposedly if you sold it "as-is" the buyer can technically sue you for all the costs necessary to make the car smoggable. But that is assuming the car was registered in the first place.

It would be a nightmare for me if that happened since the car was originally an auto converted to manual and swapped to a b16, lol.

dont hold me to this. but i think that if its non-op, you're able to sell it without a smog. but im not 100 percent sure. make sure you have a bill of sale with both signatures just to be safe.

Make the guy sign a waiver saying that he has to smog it himself.

I thought it was the seller's responsibility to smog the car???

From what I can gather, a smog certificate is not required for a non-operational status vehicle, but once a non-operational vehicle is brought into operational status, it must be smog if it missed its smog check while it was in non-operational status.

So sounds like you can sell the car as non-operational and then it because the buyers responsibility to smog it from there on.
