Only if you lie about it. In California, if you change the cluster, you should report it to the DMV so that they will note on your title that the mileage is not actual.

so if your warranty is expired you put this in, and provided the dealer hasnt recorded your milage higher then the new cluster reads, you have warranty again?

Possibily. Which is why ALL manufacturers states 3 years / 36,000 miles WHICHEVER COME FIRST. (and such). Say your car is a 2001 model and now it's 2005. 3 years passed, no matter what mileage reading you have, the warranty is still expired.

On the other hand, if you have a 2002/2003 model and you've got 36K+ miles. It is possible to swap in a lower mileage cluster to get warranty work done.

Each time you bring your car to the dealership (even an oil change) , they record your mileage. At least that's how it is here in California. So beaware...
